Terms of Service
These Terms of Service (“Terms”) are an agreement between you and emarcondes LLC (“emarcondes”, “we”, “us”), the company that makes the Meals app and runs its related services (together, “Meals”). You accept these Terms when you create an account or use Meals. How we handle your information is described in our Privacy Policy, which is part of these Terms.
1. Who can use Meals
- You must be at least 13 years old to use Meals.
- If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf.
- Meals is offered to people in the United States only.
2. What Meals does
Meals is an iPhone and iPad app for saving recipes, planning meals and shopping for groceries with your household. It includes:
- Recipe import from websites, social media posts, photos and screenshots
- A shared meal library and a weekly planner
- Grocery lists built from your plan and shared with your household in real time
We may add, change or remove features over time. Meals is currently free; if we ever charge for any part of it, we'll tell you before you're charged anything.
3. Beta versions
Meals is currently offered as a beta through Apple's TestFlight. Beta versions may contain bugs, lose data, or change or stop working without notice, so keep your own copy of anything you can't afford to lose.
4. Your account
You sign in with Apple. Keep your Apple Account secure: you are responsible for activity under your Meals account. Each account is for one person. If you think your account has been compromised, email us right away at support@trymeals.app.
5. Households
When you create or join a household, its other members can see and edit the meals, plan and grocery list you share there, and see your name. Only invite people you trust. Content you add to a household stays with it if you leave the household or delete your account.
6. Acceptable use
You agree not to:
- Use Meals for anything unlawful
- Scrape, crawl or automatically extract data from Meals
- Reverse-engineer or decompile Meals, or try to access its source code or infrastructure, except where the law allows it
- Upload or share content that infringes someone else's rights
- Abuse, harass or harm other people, including members of your household
- Try to gain unauthorized access to other accounts or our systems
- Overload, disrupt or impair Meals or the services it depends on
7. Your content
You keep ownership of the recipes, photos, plans, grocery lists and other content you put into Meals. You give us a non-exclusive, worldwide, royalty-free license to host, store, copy, process (including through the service providers that help us run Meals), display and share your content, only as needed to operate Meals. That includes sharing it with your household and with anyone you send a share link to.
This license ends when your content is deleted. It continues for content that remains in a household you shared it with after you leave or delete your account. We don't use your content for advertising or to train AI models.
8. Recipes and images from other sources
Meals can import recipes from websites, social media posts, and photos or screenshots you provide, such as pages of a cookbook. It can also find photos for your meals through image search. Recipes and photos are often protected by copyright. By importing or saving them, you confirm that you have the right to keep that content for your personal, household use, and that you will respect the original source's rights and terms.
Imported content is kept in your household's library for your own use. We don't publish or redistribute it, and we don't guarantee that content imported from other sources is accurate, complete or still available.
9. Copyright complaints
We respect copyright and respond to notices under the Digital Millennium Copyright Act. If you believe content stored in Meals infringes your copyright, email support@trymeals.app with the subject “Copyright notice” and include:
- A description of the copyrighted work
- Where the material appears, such as a shared grocery list link
- Your name, address, phone number and email address
- A statement that you believe in good faith the use isn't authorized by the owner, its agent or the law
- A statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner
- Your physical or electronic signature
We may remove material in response to a valid notice and will close the accounts of people who repeatedly infringe.
10. Feedback
If you send us ideas or feedback, including through TestFlight, we may use them to improve Meals without owing you anything.
11. Our rights
Meals, including its name, logo, design and code, belongs to emarcondes LLC. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Meals app on Apple devices you own or control, for your own non-commercial use, under these Terms.
12. Apple App Store terms
If you got Meals from Apple's App Store or TestFlight:
- These Terms are between you and emarcondes LLC only, not Apple. emarcondes LLC, not Apple, is solely responsible for Meals and its content.
- Your license to use Meals is limited to Apple devices you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for Meals. Support is provided by us at support@trymeals.app.
- If Meals fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Meals.
- We, not Apple, are responsible for addressing any claims relating to Meals, including product liability claims, claims that Meals fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- If anyone claims that Meals or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when you use Meals.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple may enforce them against you.
13. Nutrition, allergens and food safety
Nutrition values in Meals are automated estimates per serving. Recipes imported from other sources, or read automatically from text and photos, may leave out or misread ingredients, including allergens, and amounts. Meals is not medical or dietary advice. Always check ingredients, allergens and cooking instructions yourself, especially if anyone in your household has a food allergy or medical condition.
14. Disclaimer of warranties
Meals is provided “as is” and “as available”. To the maximum extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that Meals will be uninterrupted, error-free or secure, or that your data will never be lost.
15. Limitation of liability
To the maximum extent the law allows, emarcondes LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, arising from your use of or inability to use Meals, even if we were told such damages were possible. Our total liability for any claim relating to Meals or these Terms is limited to the greater of the amount you paid us in the 12 months before the claim or $10 USD.
Some states don't allow certain warranties to be disclaimed or liability to be limited, so some of the limits above may not apply to you.
16. Indemnification
To the extent the law allows, you agree to defend and hold harmless emarcondes LLC from claims, losses and costs (including reasonable attorneys' fees) arising from your content, your misuse of Meals or your violation of these Terms.
17. Ending your use of Meals
You can stop using Meals at any time and delete your account in Settings > Account > Delete Account, or by emailing support@trymeals.app.
We may suspend or close your account if you violate these Terms or if we're required to by law. We'll usually tell you first, unless the violation is serious or the law doesn't allow it. We may also stop offering Meals; if we do, we'll give you reasonable notice when we can. When an account is closed, we delete its data as described in our Privacy Policy. Sections 7 through 9 and 13 through 19 still apply after your account is closed.
18. Changes to these Terms
We may update these Terms. The date at the top shows the latest version. Before a material change takes effect, we'll tell you in the app. If you keep using Meals after a change takes effect, you accept the updated Terms; if you don't agree, you can delete your account.
19. Governing law and disputes
If you have a problem with Meals, please email support@trymeals.app first. Most concerns can be resolved quickly that way, and we ask that you give us 30 days to try before starting a formal claim. Either of us may bring an individual claim in small claims court if it qualifies. Nothing in these Terms takes away rights you have under the consumer protection laws of your state.
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any claim that isn't brought in small claims court will be resolved in the state or federal courts located in Washington, and you and we agree to those courts' jurisdiction.
20. General terms
- These Terms and our Privacy Policy are the entire agreement between you and us about Meals.
- If any part of these Terms can't be enforced, the rest stays in effect.
- If we don't enforce a part of these Terms, we haven't waived our right to later.
- You may not transfer these Terms to anyone else. We may transfer them as part of a merger, acquisition or sale of Meals.
